Whoosh Care Terms and Conditions 

1. OFFER OF ENROLMENT

a) Whoosh Care may decline to enrol a child or continue an enrolment if management believes the service is unable to adequately care for a child due to any additional needs, medical needs, or behaviours.

b) Whoosh Care reserves the right to terminate, without notice, the services in respect of any child if it believes (in its absolute discretion) that to do so is in the best interests of the child, other children enrolled at the service, the team, or the business operations or the reputation of Whoosh Care.

c) Whoosh Care reserves its right to refuse entry to any of its services to anyone for any reason.

d) Parents/guardians acknowledge that Whoosh Care will record details for each session of care for all children in attendance and submit weekly attendance records online using the CRN details provided. Parents/ Guardians agree to confirm the enrolment on MyGov to receive Child Care Subsidy entitlements.

e) Parents/guardians delegate the custody and control of their enrolled child to Whoosh Care whilst Whoosh Care is caring for the child and agree to accept the carers that Whoosh Care provides to care for the child and the facilities at which the care is provided.

f) Parents/guardians acknowledge that, although Whoosh Care warrants that it will always and to the best of its ability use all reasonable care in respect to each child, there are inherent and unforeseeable dangers and difficulties in providing the services and Whoosh Care cannot guarantee the well-being of their child. Whoosh Care does not accept any liability for personal injury or property damage caused, unless by proven negligence of Whoosh Care employees or Approved Provider or is otherwise required by law.

g) Parents/guardians authorise Whoosh Care to take any action it considers necessary, appropriate and in the best interests of their child to protect each child or any other children at the service or otherwise under its control.

h) Parents/guardians will partner with Whoosh team members to create an environment of respect and appropriate behaviour.

i) Parents agree that Whoosh Care may contact the preschool/ childcare centre/ previous school your child has attended and is noted on the enrolment form directly to request information related to any of the questions answered on the enrolment form.

j) Whoosh Care accepts casual bookings for each school holidays from week five of the preceding school term, holiday care bookings are not guaranteed and are booked on a first come, first served basis.

k) Parents/guardians will ensure that their child, upon arrival are signed in and when collected are signed out using the OWNA app unless alternative arrangements are agreed in writing with Whoosh Care management.

  

2. PAYMENT OF FEES

a) Parents/guardians acknowledge that the child’s enrolment (and the obligation to pay the service fees) starts on the commencement date as set out in the enrolment confirmation; and continues until terminated under these terms.

b) Child Care Subsidy entitlements are not able to be claimed on days’ absences at the beginning or end of an enrolment as per Centrelink policy. 

c) Parents/guardians will pay the service fees to Whoosh Care via the direct debit service provided by a third party. Direct debit fees will be applied to the deduction.

d) Parent/guardians agree that any declined direct debit may be resubmitted by Whoosh Care without seeking approval or consent at any time to seek payment of the amount due, and that parents/guardians will be responsible for any additional costs and charges which may arise as result of the resubmission, including any fees charged directly by my financial institution, the third-party direct debit provider. Repeated decline fees may result in Whoosh Care ceasing to provide their services and terminate the enrolment of your child.

e) The fees are payable for: each day on which the child is enrolled; and the reservation of the child’s place at the service on each booked day and not the attendance of the child.

f) A $50 non-refundable enrolment fee is applicable to each enrolling family at Whoosh Care Annandale, Whoosh Care Glebe, Whoosh Care Leichhardt Town Hall and Whoosh Care Leichhardt. If an enrolment is ended prior to the start date the administration fee remains non-refundable.

g) Fees are payable on all public holidays that fall during the school term.

h) Fees are payable on school pupil free days when care is offered.

i) Families will pay a bond equal to 2 weeks’ fees (Whoosh full fee) with the initial fee payment. Bonds will be adjusted with each change to the enrolment.

j) Each enrolment will roll over to the following school year unless the family provides 2 school weeks’ written notice to end the enrolment or the child commences high school.

k) Fees may increase with 30 days’ email notice to the account holder.

l) A late fee will be charged on each occasion that a child is collected/departs after closing time. The late fee is charged in 15 min increments at $20 per increment.

m) A minimum of 24 hours’ notice is required for cancelling a casual afternoon booking. If less notice is provided the fee for the session is payable.

n) A minimum of two weeks notice is required for cancelling a holiday care booking. If less notice is provided the fee for the session is payable.

o) Ad-hoc additional care sessions for are at the usual rate.

p) Parents/guardians will inform Whoosh Care of any absence from after school care. This will ensure that our team does not spend valuable time searching for a child that is not attending care. A $15 fee will be charged when a Whoosh Care team member calls to determine a child's whereabouts or is required to check your child's school attendance with the school office.

q) If your child attends Whoosh Care without a booking, a fee of $10 will be added to the session fee. All Children are required to have a confirmed booking prior to attendance and should not show up at Whoosh without prior arrangement or a booking via the casual booking calendar.

r) Parents/guardians will inform Whoosh Care when an authorised person, other than the parent/guardian is collecting their child from care. Written authorisation is required for a person not authorised on the enrolment form to collect a child.

s) Parents/guardians acknowledge that Whoosh Care collects personal information to provide services and for invoicing purposes. Whoosh Care may disclose this personal information to its associated companies, to credit reporting agencies and other third parties as part of provision of the services. If there is an overdue account Whoosh Care may disclose personal information to debt collection agencies, the fees associated with part or total account recovery will be applied to the Whoosh Care account holder.

  

3. WHOOSH CARE BEHAVIOUR MANAGEMENT AGREEMENT

a) Parents/Guardians are expected to treat all Whoosh Care team members with respect and agree to always behave appropriately when dealing with any agent or Whoosh employee.

b) Swearing, raised voices and rudeness directed at team members will not be tolerated.

c) Children enrolled at Whoosh Care agree to follow the Whoosh Care Code of Behaviour. Unacceptable behaviour from a parent/guardian may result in immediate termination of their child’s enrolment.

d) Parents/guardians are expected to show support, and work in partnership with the Whoosh Care educators regarding their child/ren’s behaviour.

e) Parents/guardians agree that if their child continues to demonstrate unacceptable behaviour after Whoosh behaviour management processes have been followed, they will be required to be collected; parents/guardians agree to make immediate arrangements to collect their child from Whoosh Care.

f) Violence between children or towards a child will not be tolerated; if a child is violent towards another child an automatic 2 'enrolled day' suspension will be applied. If repeated acts of violence towards other children occur the child's enrolment may be withdrawn.

g) Whoosh Care must provide a safe working environment; if a child is violent towards a team member an automatic 2 'enrolled day' suspension will be applied. If a second act of violence toward a team member occurs the child's enrolment will be withdrawn.

h) Our team will participate in behaviour management training and regular discussions to ensure consistency, appropriate strategies, confidence in managing situations and positive interactions with the children.

i) Our team will report breaches of the code to families where necessary and work with families to create Behaviour Support Plans when the code is breached regularly.

  

4. EXCURSIONS AND USE OF LOCAL PLAY SPACES

a) Parents/guardians consent to their child participating in regular, local excursions which do not include any type of transportation or the crossing of main roads. This includes visits to local parks and playgrounds. Excursion permission notes will be provided for all planned outings along with a risk assessment.

b) During emergency drills and actual emergencies, Whoosh team members will follow our emergency plans; at times, children may evacuate the Whoosh premises to our emergency muster points.

c) WHOOSH CARE BUS - Whoosh Care Leichhardt, Annandale ONLY. Families enrolling children grant permission for their child/ren to travel by private bus provided by Whoosh Care to and from school and the Whoosh Care service accompanied by a Whoosh Care team member. Children from LPS will cross Marion St at the lights and board the bus from our reserved space in the Marion St car park. Written authorisation will be sought each year to meet the Education and Care Regulations, regulation 107, requirements.

  

5. NOTICE PERIOD FOR ENDING CARE

a) Whoosh Care notice period to cease or decrease care is 2 school term weeks. Fees are payable for the notice period at the child’s current enrolment attendance.

b) Notice must be supplied in writing to Whoosh Care management, not the service team.

c) Any deposit/ bond funds will be refunded 2 weeks after the end of care to allow time for any outstanding CCS to be applied.

d) All new year enrolments including kindergarten will commence from the second week of the school term at the latest.

e) Parents and guardians agree that if less than the required Notice Period is provided, parents/guardians will be obliged to pay Whoosh Care an amount equivalent to the relevant Notice Period’s worth of gross Childcare Fees (excluding CCS, Child Care Fee Assistance or third-party payers) that would otherwise be owed to Whoosh Care based on my use of the Services at the time of giving notice. CCS is not applicable to absences at the end of an enrolment.

  

6. MEDICAL AUTHORISATIONS AND CONSENTS

a) Parents/guardians accept that at the discretion of Whoosh Care that if their child is deemed contagious or too ill to attend the service Whoosh Care has the final decision and the parents/guardians agree to ensure their child is collected promptly from the service after being informed of such a decision.

b) Parents/guardians acknowledge and agree that in the event of an outbreak of a vaccine-preventable disease at the service Whoosh Care is required to notify the NSW Department of Health of any children that have not been immunised. If a child is not immunised the child may be excluded from attending the service for such time as the NSW Department of Health determines and the service fee must still be paid.

c) Parents/guardians accept that if their child has a contagious illness, they will not return the child to the service until: i) Whoosh Care has advised that their child may return to the service or has advised them that their child may return to the service after a specified period and that period has passed; or ii) A qualified and registered medical practitioner issues their child with a medical certificate confirming they are no longer contagious and that certificate is made available to Whoosh Care.

d) Parents/guardians consent to first aid being administered to their child by a person who is the holder of a current first aid certificate.

e) Parents/guardians understand and accept that the service team can only administer medication to their child at their request if: i) The medication has been authorised by the child’s parent or guardian or a qualified medical practitioner; and ii) The details of the medication and its administration have been accurately recorded in the Medication Authorisation Form signed by the child’s parent or guardian. Paracetamol will not be provided by the service to be given to any child.

f) In the event of any illness or injury to their child whilst their child is in the custody or control of Whoosh Care and if in the opinion of Whoosh Care, it is necessary to do so, parents/guardians authorise Whoosh Care to seek urgent: i) Medical or dental treatment from the doctor or dentist nominated on the enrolment form, ii) From another doctor or dentist or from a hospital or ambulance service, or iii) Assistance from some other person nominated on the enrolment form. iv) Ambulance transportation. Parents and guardians accept that the cost of the Ambulance will be their responsibility. Parents/guardians will reimburse Whoosh Care for any charges, costs or expenses incurred by it in obtaining the medical or hospital treatment.

g) Whoosh Care will inform parents/guardians as soon as possible about the nature of the illness or injury to their child.

h) Parents/guardians authorise Whoosh Care to apply an SPF50+ sunscreen provided by Whoosh Care to all unprotected areas of skin on their child, as necessary.

i) Parents/guardians agree to insect repellent being applied to their child when deemed necessary by the Whoosh Care team.

j) Parents/guardians authorise Whoosh Care to check their child’s head if it is concerned about the presence of head lice. This will be conducted in a respectful manner.

k) Parents/guardians will provide a copy of a Conscientious Objector Letter or their child’s immunisation statement from Medicare. Parents/guardians will ensure that if their child’s immunisations change, they will provide an updated record to Whoosh Care.

  

7. PHOTOS AND DOCUMENTATION

a) Parents/guardians consent to Whoosh Care providing or bringing third party service providers into the service to provide, activities or programs that Whoosh Care consider to be in the interests of the children and consent to the child’s participation in any of those activities or programs. Parents/guardians understand that Whoosh Care will notify them of these activities or programs. Example Sport Coaches, visit from local emergency services.

b) Parents/guardians consent to their child being photographed or filmed at the service or during an excursion Whoosh Care has organised. Parents/guardians consent to any of those images, together with their child’s first name being used by Whoosh Care in connection to; i) Keeping records of their child’s service activities; ii) Recording dietary or allergy information or for other health or wellbeing purposes; iii) Use on our OWNA app. (opt out via email) v) Internal training purposes.

c). St James Catholic School is not responsible for the storage of Whoosh enrolment forms and related information and will not accept responsibility for any breach of security by an external provider.

  

8. HIRING WHOOSH CARE TEAM MEMBERS FOR BABYSITTING

At Whoosh Care, we don’t prohibit our educators from agreeing to babysit for families enrolled in our service; however, our policy is that:

a) This is a separate arrangement to the care and education provided by Whoosh Care.

b) Whoosh Care will not be held liable should anything happen whilst these arrangements outside of Whoosh Care enrolments occur. 

c) Notwithstanding that any babysitting arrangements are separate to Whoosh Care, if an educator is found to have acted in a way that does not align to Whoosh Care policies and procedures and/or is in breach of their obligations as an employee of Whoosh Care, they may be subject to disciplinary action up to and including termination of their employment.

d) Families acknowledge that Whoosh Care accepts no responsibility should any kind of incident occur whilst a Whoosh Care employee is providing babysitting services.

e) Families agree that Whoosh Care is not liable for any kind of incident that may occur whilst a Whoosh Care employee is providing babysitting services.

f) Families choosing to use educators as babysitters must understand that: i)Whoosh Care will not be responsible for incidents or breaches that occur during the private arrangement; ii) Whoosh Care aims to employ educators of a high standard, who are suitable for our service. iii) Whoosh Care is unable to provide assurance to families of an educator’s suitability to look after children, unsupervised, in a babysitting environment outside of our service.

g) If an educator is to collect a child from the service, they must be authorised in writing and listed as an additional contact on the enrolment.

h) Educators have a duty as Mandatory Reporters to report any concern for a child’s safety and wellbeing observed in and outside of work, including child protection concerns.

 

TERMS AND CONDITIONS AGREEMENT

By enrolling with Whoosh Care and parents/guardians certify that they have read and agree to the terms and conditions.

I agree to abide by these terms and conditions and to ensure that all authorised persons who may attend the Centre on my behalf to drop-off or pick-up the Child will also abide with these terms and conditions. 

I acknowledge that it is my responsibility to ensure that I am familiar with Whoosh Care policies and procedures and that they are available on the Whoosh Care website and via the OWNA app.

I warrant that the information I have provided to Whoosh Care in the Enrolment Form and all other information I have provided with respect to my child is true and correct in every respect to the best of my knowledge and ability.  I undertake to inform Whoosh Care immediately should there be any change to this information.

I understand these terms and conditions are subject to change without notice to me, from time to time at Whoosh Care’s sole discretion. I will not be required to acknowledge any changes provided that the updated terms and conditions are available to be viewed online at www.whooshcare.com.au
